Terms of service

The deal, in plain English.

Last updated 6 October 2026. These terms are deliberately short and will grow up alongside the product.

The service

Whale is a hosted observability platform: you send logs, metrics and traces, and we store, search, alert on and visualise them. By creating a workspace you agree to these terms; if you are accepting for a company, you confirm you may bind it.

Your account and acceptable use

Keep your credentials and API keys secret — activity under your keys is yours. Send only data you have the right to send, and don't use Whale to break the law, probe or disrupt the service, or resell it as your own. We may suspend accounts that threaten the platform or other tenants, and we'll tell you when we do.

Your data

Telemetry you send remains yours. You grant us only the licence needed to run the service on it — storage, indexing, display, alerting. You can export it over the query API at any time, and it is deleted when your account closes or on request. How we handle personal data is covered by the privacy policy.

Plans and billing

The free tier is free. Paid plans are billed in advance, monthly or yearly, at the prices on the pricing page. You can cancel at any time: your plan stays active until the end of the period you have paid for, then moves to the free tier. Overage billing is not switched on yet; when it is, the per-million rate on your plan applies.

The honest disclaimers

The service is provided "as is", without warranties, and without a promised service level — uptime targets and SLAs are available on Enterprise agreements. To the extent the law allows, our total liability for any claim is limited to the greater of $100 or the amounts you paid us in the twelve months before the claim. Don't make Whale the only copy of data you cannot lose.

Ending things, and changes

You can close your workspace at any time; export your data first, because closure deletes it. We can end or change the service with reasonable notice to account holders, and material changes to these terms will be announced by email before they take effect. These terms are governed by the laws of India. Whale is operated by the team at balajitech.xyz.
